28. NEW COMMERCIAL MANAGEMENT CONCESSIONS AGREEMENT WITH CAPTAIN CLINT SAILING, LLC Approve a new Commercial Management Concessions Agreement with Captain Clint Sailing, LLC that will allow this Concessionaire to manage, operate and maintain a commercial concession for sailing from the waters of Lake Pleasant Regional Park, within the Maricopa County Regional Park System. Captain Clint Sailing, LLC will provide a commercial concession for sailing, to include American Sailing Association (ASA) lessons, ASA certifications and sail boat tours at Lake Pleasant Regional Park, within the Maricopa County Regional Park System. In doing so, Concessionaire will be providing an additional service to the recreational public. The Concessionaire is responsible for all costs associated with the operation, maintenance, safety, as well as all licensing and permits. The term of this Agreement is from the Board of Supervisors’ approval through December 31, 2013, with ten (10) one (1) year automatic renewals. (C-30-13-019-M-00)

86. TERMINATION OF COMMERICAL MANAGEMENT CONCESSIONS AGREEMENT WITH CAPTAIN CLINT SAILING, LLC Approve the termination of the Commercial Management Concessions Agreement (C-30-13-019-M-00) entered into between Maricopa County and Captain Clint Sailing, LLC (Concessionaire) on April 10, 2013 (Agreement), which authorized the Concessionaire to manage, operate and maintain a concession within the Maricopa County Regional Park System, and authorize Parks and Recreation Department staff to give formal notice to Concessionaire of the Agreement termination. This termination is based upon the nonperformance in operating the concession activities and failure to provide proof of insurance. Termination is per Section 2.6 Termination for Cause, Sub-section 2.6.3 “Unsatisfactory performance on the part of the Concessionaire or failure to comply with the provisions of this Agreement.” Termination will be effective on December 31, 2017.
