43. NEW COMMERCIAL MANAGEMENT CONCESSIONS AGREEMENT WITH BLAZIN BARBEQUE, LLC, Approve a new Commercial Management Concessions Agreement with Blazin Barbeque, LLC that will allow this Concessionaire to manage, operate and maintain a commercial food concession from land at all Parks and the waters of Lake Pleasant within the Maricopa County Regional Park System. Blazin Barbeque, LLC will provide upscale food items (smoked meats such as brisket, ribs, etc) as an additional service to the recreational public. Food sales will be conducted at each Park as well as on a pontoon boat at Lake Pleasant. The Concessionaire is responsible for all costs associated with the operation, maintenance, safety, as well as all licensing and permits. The term of this Agreement is from the date of the Board of Supervisors approval through December 31, 2013, with ten (10) one (1) year automatic renewal options. (C-30-13-023-M-00)

40. TERMINATION OF COMMERCIAL MANAGEMENT CONCESSION AGREEMENT WITH BLAZIN BARBEQUE, LLC Approve the termination of the Commercial Management Concessions Agreement (C-30-13-023-M-00) between Maricopa County and Blazin Barbeque, LLC (Concessionaire) on May 22, 2013 (Agreement) and delegate authority to Director of Maricopa County Parks and Recreation Department (MCPRD) or his designee to provide prior written notice to Concessionaire to terminate the Agreement. The Agreement authorized the Concessionaire to manage, operate and maintain a concession within the Maricopa County Regional Park System. Termination will be effective on September 4, 2019. This termination is due to the nonperformance in operating the concession activities and failure to provide proof of insurance. Termination is per Section 2.6 Termination for Cause, Sub-section 2.6.3 “Unsatisfactory performance on the part of the Concessionaire or failure to comply with the provisions of this Agreement.” All activities for this concession are located in Supervisory District #4.
