35. NEW COMMERCIAL MANAGEMENT CONCESSIONS AGREEMENT WITH MD RANCH, LLC Approve a new Commercial Management Concessions Agreement with MD Ranch, LLC that will allow this Concessionaire to manage, operate and maintain a commercial concession from within the Maricopa County Regional Park System. MD Ranch will provide an equestrian trail riding service within the Maricopa County Regional Park System and in so doing will be providing an additional service to the recreational public. The Concessionaire is responsible for all costs associated with the operation, maintenance, safety, licensing and permits. The term of this Agreement is from the Board of Supervisions Approval through December 31, 2014, with ten (10) one (1)-year automatic renewal options. (C-30-14-027-M-00)

38. TERMINATION OF COMMERCIAL MANAGEMENT CONCESSION AGREEMENT WITH MD RANCH, LLC Approve the termination of the Commercial Management Concession Agreement (C-30-14-027-M-00) between Maricopa County and MD Ranch, LLC (Concessionaire) on March 26, 2014 (Agreement) and delegate authority to Director of Maricopa County Parks and Recreation Department (MCPRD) or his designee to provide prior written notice to Concessionaire to terminate the Agreement. The Agreement authorized the Concessionaire to manage, operate and maintain a concession within the Maricopa County Regional Park System. Termination will be effective as of September 4, 2019 This termination is due to Maricopa County and Concessionaire entering into a new Commercial Management Concession Agreement (New CMCA), covering the same concession as the Agreement and requiring the Concessionaire to now pay the greater of an annual minimum fee or an annual fee based on 10% of gross revenue, among other things. Pursuant to Resolution C-30-18-016-M-00, the Board has delegated signature authority to the MCPRD Director to enter into the New CMCA with the Concessionaire. All activities for this concession were located at San Tan Regional Park in Pinal County. (C-30-14-027-M-01)
