38. NEW COMMERCIAL MANAGEMENT CONCESSIONS AGREEMENT WITH AZ WATER CRAFT, LLC Approve a new Commercial Management Concessions Agreement with AZ Water Craft, LLC that will allow this Concessionaire to manage, operate and maintain a commercial concession within the Maricopa County Regional Park System. AZ Water Craft will provide boat rentals as a concession to the recreational public within Lake Pleasant Regional Park. Rentals will be transacted off-site and concessionaire will deliver the boats to Lake Pleasant for the client. Concessionaire is responsible for all costs associated with the operation, safety, maintenance, insurance, licensing and permits. The term of this Agreement is from the Board of Supervisors’ approval through December 31, 2016, with ten (10) one (1) year automatic renewals, unless either party gives prior notice of intent not to renew. The activities for this concession will be located in Supervisory Districts No. 4. (C-30-17-003-M-00)

47. TERMINATION OF COMMERCIAL MANAGEMENT CONCESSION AGREEMENT WITH AZ WATER CRAFT, LLC Approve the termination of the Commercial Management Concession Agreement (C-30-17-003-M-00) between Maricopa County and AZ Water Craft, LLC (Concessionaire) on August 3, 2016 (Agreement) and delegate authority to Director of Maricopa County Parks and Recreation Department (MCPRD) or his designee to provide prior written notice to Concessionaire to terminate the Agreement. The Agreement authorized the Concessionaire to manage, operate and maintain a concession within the Maricopa County Regional Park System. Termination will be effective on September 4, 2019. This termination is due to the nonperformance in operating the concession activities and failure to provide proof of insurance. Termination is per Section 2.6 Termination for Cause, Sub-section 2.6.3 “Unsatisfactory performance on the part of the Concessionaire or failure to comply with the provisions of this Agreement.” All activities for this concession are located in Supervisory District #4.
