40. NEW COMMERCIAL MANAGEMENT CONCESSIONS AGREEMENT WITH COMMERCIAL DIVERS INTERNATIONAL, INC. Approve a new Commercial Management Concessions Agreement (CMCA) with Commercial Divers International, Inc. (CDI) that will allow this concessionaire to manage and operate a commercial scuba diving concession within the Maricopa County Regional Park System. Approve the CMCA between Maricopa County and CDI in order to manage and operate a commercial scuba diving concession at Lake Pleasant Regional Park, within the Maricopa County Regional Park System. CDI offers complete commercial diver training program that will prepare participants to succeed in the marine construction and commercial diving industries after 28 weeks. Beginning in a controlled environment at the CDI campus, participants will learn to use industry standard equipment, then use their training in the open water at Lake Pleasant. The Concessionaire is responsible for all costs associated with the operation, safety, maintenance, insurance, licensing and permits. The term of this Agreement is from the Board of Supervisors’ approval through December 31, 2017, with ten (10) one (1) year automatic renewals, unless either party gives prior notice of intent not to renew. The activities for this concession will be located in Supervisor District #4. (C-30-17-028-M-00)

83. TERMINATION OF COMMERCIAL MANAGEMENT CONCESSION AGREEMENT WITH COMMERCIAL DIVERS INTERNATIONAL, INC. Approve the termination of the Commercial Management Concession Agreement (C-30-17-028-M-00) between Maricopa County and Commercial Divers International, Inc. (Concessionaire) entered on July 13, 2017 (Agreement) and delegate authority to Director of Maricopa County Parks and Recreation Department (MCPRD) or his designee to provide prior written notice to Concessionaire to terminate the Agreement. The Agreement authorized the Concessionaire to manage, operate and maintain a concession within the Maricopa County Regional Park System. Termination will be effective as of December 31, 2019. This termination is due to the nonperformance in operating the concession activities and failure to provide proof of insurance. Termination is per Section 2.6 Termination for Cause, Sub-section 2.6.3 “Unsatisfactory performance on the part of the Concessionaire or failure to comply with the provisions of this Agreement.” All activities for this concession are in Supervisory District #4.
