74. NEW COMMERCIAL MANAGEMENT CONCESSIONS AGREEMENT WITH GORDOS CHUCHERIA’S Approve a new Commercial Management Concessions Agreement (CMCA) with Gordos Chucheria’s that will allow this concessionaire to manage and operate a commercial food concession within the Maricopa County Regional Park System. Gordos Chucheria’s will provide food items as an additional service to the recreational public. Food sales will be conducted at each Park within the Maricopa County Regional Park System. The concessionaire is responsible for all costs associated with the operation, safety, maintenance, insurance, licensing and permits. The term of this Agreement is from the Board of Supervisors’ approval through December 31, 2017, with ten (10) one (1) year automatic renewals, unless either party gives prior notice of intent not to renew. The activities for this concession will be located in all Supervisory Districts. (C-30-18-001-M-00)

82. TERMINATION OF COMMERCIAL MANAGEMENT CONCESSION AGREEMENT WITH GORDOS CHUCHERIA’S Approve the termination of the Commercial Management Concession Agreement (C-30-18-001-M-00) between Maricopa County and Gordos Chucheria’s (Concessionaire) entered on July 26, 2017 (Agreement) and delegate authority to Director of Maricopa County Parks and Recreation Department (MCPRD) or his designee to provide prior written notice to Concessionaire to terminate the Agreement. The Agreement authorized the Concessionaire to manage, operate and maintain a concession within the Maricopa County Regional Park System. Termination will be effective as of December 31, 2019. This termination is due to the nonperformance in operating the concession activities and failure to provide proof of insurance. Termination is per Section 2.1.2 Termination for Cause, Sub-section 2.1.2.4 “Unsatisfactory performance on the part of the Concessionaire or failure to comply with the provisions of this Agreement.” All activities for this concession are in all Supervisory Districts.
