44. NEW COMMERCIAL MANAGEMENT CONCESSIONS AGREEMENT WITH MICHAEL SIMPSON, DBA ARIZONA DESERT DOGS Approve a new Commercial Management Concessions Agreement (CMCA) with Michael Simpson, dba Arizona Desert Dogs that will allow this concessionaire to manage and operate a commercial food concession within the Maricopa County Regional Park System. Arizona Desert Dogs will provide food items as an additional service to the recreational public. Food sales will be conducted at each Park within the Maricopa County Regional Park System. The concessionaire is responsible for all costs associated with the operation, safety, maintenance, insurance, licensing and permits. The term of this Agreement is from the Board of Supervisors’ approval through December 31, 2017, with ten (10) one (1) year automatic renewals, unless either party gives prior notice of intent not to renew. The activities for this concession will be located in all Supervisory Districts. (C-30-18-003-M-00)

39. TERMINATION OF COMMERCIAL MANAGEMENT CONCESSION AGREEMENT WITH MICHAEL SIMPSON, DBA ARIZONA DESERT DOGS Approve the termination of the Commercial Management Concession Agreement (C-30-18-003-M-00) between Maricopa County and Michael Simpson, dba Arizona Desert Dogs (Concessionaire) on September 6, 2017 (Agreement) and delegate authority to Director of Maricopa County Parks and Recreation Department (MCPRD) or his designee to provide prior written notice to Concessionaire to terminate the Agreement. The Agreement authorized the Concessionaire to manage, operate and maintain a concession within the Maricopa County Regional Park System. Termination will be effective as of September 4, 2019 This termination is due to Maricopa County and Concessionaire entering into a new Commercial Management Concession Agreement (New CMCA), covering the same concession as the Agreement and requiring the Concessionaire to now pay the greater of an annual minimum fee or an annual fee based on 10% of gross revenue, among other things. Pursuant to Resolution C-30-18-016-M-00, the Board has delegated signature authority to the MCPRD Director to enter into the New CMCA with the Concessionaire.
