85. TERMINATION OF SEVERAL COMMERICAL MANAGEMENT CONCESSION AGREEMENTS Approve the termination of the Commercial Management Concession Agreements between Maricopa County and Concessionaires as per the table below (Agreements) and delegate authority to Director of Maricopa County Parks and Recreation Department (MCPRD) or his designee to provide prior written notice to each Concessionaire to terminate the Agreements. The Agreements authorized the Concessionaires to manage, operate and maintain concessions within the Maricopa County Regional Park System. Terminations will be effective as of December 31, 2020. These terminations are due to Maricopa County and each Concessionaire entering into a new Commercial Management Concession Agreement (New CMCA), effective as of January 1, 2021, covering the same concessions as stated in the Agreement and requiring the Concessionaires to pay the greater of an annual minimum fee or an annual fee based on 10% of gross revenue or in the case of scuba certification, annual minimum fee or scuba participant fees of $3.00 each, among other things. Pursuant to Resolution C-30-18-016-M-00, the Board has delegated signature authority to the MCPRD Director to enter into the New CMCA with the Concessionaires.
