31. AMENDMENT TO CONTRACT FOR DESIGN, CONSTRUCTION, USE AND MAINTENANCE OF A DOCK AND BOATHOUSES Approve and authorize the Chairman to execute Amendment One to the Contract for Design, Construction, Use and Maintenance of a Dock and Boathouses to be Used Exclusively by Governmental Entities between Maricopa County (County) and Scorpion Bay Holding, LLC (Concessionaire) (C-30-19-014-M-00) to effectuate an increased cost of construction per the County’s request. The County changed the scope of the work by adding eight (8) feet of length to two (2) boathouses to accommodate the County’s two (2) navigational-aid boats. The change in the scope of work described herein resulted in an increase in construction costs in the amount of nineteen thousand four hundred eighty dollars and seven cents ($19,480.07). Therefore, the revised Construction Costs shall not exceed nine hundred eighteen thousand one hundred eighty dollars and seven cents ($918.180.07). This is located in Supervisory District #4. 34. BILL OF SALE GOVERNMENTAL DOCK AND BOATHOUSES EXCLUSIVE USE AT SCORPION BAY MARINA Approve and authorize the Chairman to execute acceptance of the Bill of Sale whereby Scorpion Bay Holdings, LLC(Concessionaire) is selling the dock and boathouses, for use exclusively by Governmental Entities, to the County. This Bill of Sale is being issued as per the terms of the Contract for Design, Construction, Use and Maintenance of a Dock and Boathouses to be Used Exclusively by Governmental Entities between the County and Scorpion Bay Holdings, LLC (C-30-19-014-M-00) (Agreement), pursuant to which the dock and boathouses were constructed for the exclusive use of the County and its governmental invitees (Project). As provided in the Agreement, within ten (10) days of final payment for the design and construction of the Project, the Concessionaire shall execute the Bill of Sale (Exhibit E).This is located in Supervisory District #4. 40. AMENDMENT TO CONTRACT WITH SCORPION BAY HOLDINGS LLC FOR DESIGN, CONSTRUCTION, USE AND MAINTENANCE OF A DOCK AND BOATHOUSES Approve and authorize the Chairman to execute Amendment Two to the Contract for Design, Construction, Use and Maintenance of a Dock and Boathouses to be Used Exclusively by Governmental Entities between Maricopa County (County) and Scorpion Bay Holdings LLC (Concessionaire) (C-30-19-014-M-01) as amended, to effectuate a decreased cost of construction per the Concessionaire’s request. The Concessionaire has requested a deduction in the permit fees and contingency funds and therefore changed the scope of the work. The change in the scope of work described herein resulted in a decrease in construction costs in the amount of three thousand three hundred sixty seven dollars and fifty one cents ($3,367.51). Therefore, the revised construction costs shall not exceed nine hundred fourteen thousand eight hundred twelve dollars and fifty six cents ($914,812.56). This is located in Supervisory District #4.
