81. USE MANAGEMENT AGREEMENT WITH PHOENIX KART RACING ASSOCIATION, INC Approve and execute the Use Management Agreement (“Agreement”) between Maricopa County and Phoenix Kart Racing Association, Inc. (“Concessionaire”), for the promotion, development, management, improvement, operation and maintenance of the existing asphalt track kart racing facility at Adobe Dam Regional Park (“Adobe”). All development costs will be at the expense of Concessionaire. The Flood Control District of Maricopa County (District) and Maricopa County entered into a Joint Use Agreement for recreation management of certain District lands at Adobe. All underlying property interests will remain with Maricopa County and the District in accordance with the Agreement. Maricopa County, through its Parks and Recreation Department (“Parks”), continues to pursue additional recreational opportunities, through concessionaires, that will enable residents and visitors of Maricopa County to enjoy a safe and meaningful outdoor experience. In June 2018, the County, through the Maricopa County Office of Procurement Services, issued a Invitation to Negotiate (Serial 180246-ITN) for public-private partnership opportunities for the promotion, management, operation, maintenance and improvements to the existing asphalt track kart racing facility at Adobe. Concessionaire was selected as the successful respondent and has negotiated the Agreement with the County. Concessionaire is a 501(c)(3) nonprofit organization. Under the Agreement Concessionaire may provide improvement and additional recreational amenities on approximately twenty (20) acres at Adobe. Development may be phased over the term of the Agreement. The term of the Agreement is twenty (20) years. Upon Concessionaire’s request and at the County’s sole discretion, this Agreement may be renewed for a period of up three (3) additional five (5) year terms, subject to the conditions as outlined in the Agreement. Specific parameters for the activities in the Agreement are provided as an Annual Management Plan (“AMP”) to identify management, operational procedures and methodologies to clarify responsibilities, understandings and actions in place for each specific year as new phases are developed and to advance the overall development of the complex. The activities for this concession will be located in Supervisory District #3. (C-30-21-012-X-00)
