21. EMPLOYEE BENEFITS PLAN AND ADMINISTRATIVE CHANGES FOR FY 2020-21 Approve the Maricopa County Benefits Plan (Tenth Amendment and Restatement) document effective July 1, 2020, attached as Exhibit A. The plan document governs how employee health and welfare benefits (such as medical, prescription, behavioral health, etc.) are administered. These documents supersede all previous plan documents. New or amended features are shown redlined with tracked changes attached for convenience as Exhibits A and B. The following is a summary of the substantive changes: Tenth Amendment - Effective July 1, 2020 • 2.16 - Change definition of employee eligibility for benefits from 19 hours to 20 hours • 4.12(b) – Amend "Change in Status" to include compliance with HIPAA Special Enrollment rules and to update provision language to be more user-friendly and consistent with the Plan's design and permitted election change events provided under Section 125 of the Internal Revenue Code. The Maricopa County Benefits Plan document governs basic issues of plan eligibility, participation (enrollment), coverage, payroll withholding, and funding accounts pursuant to the Internal Revenue Code. The document does not define specific benefit programs, which are adopted by the Board of Supervisors in separate actions. Part-time eligibility for benefits at the County (medical, dental, vision, life, etc.) is currently below the industry norm at 19 hours. No other employer we have identified, in either the public or private sector, offers this. (C-31-20-037-2-00)

32. MARICOPA COUNTY BENEFITS PLAN ELEVENTH AMENDMENT AND RESTATEMENT Approve the Maricopa County Benefits Plan (Eleventh Amendment and Restatement), attached as Exhibit A, which shall govern how employee health and welfare benefits (such as medical, prescription, behavioral health, etc.) are administered. This document shall consolidate and supersede the following four existing plan documents: (i) the Maricopa County Benefits Plan (Tenth Amendment and Restatement) (C-31-20-037-2-00); (ii) the Maricopa County Dependent Care Flexible Spending Account Plan (Fifth Amendment and Restatement) (C-39-17-016-M-00); (iii) the Maricopa County Health Care Flexible Spending Account Plan (Fifth Amendment and Restatement) (C-39-17-016-M-00); and (iv) the Maricopa County Limited Scope Flexible Spending Account Plan (Second Amendment and Restatement) (C-39-17-016-M-00). This document makes technical corrections and updates to reflect current applicable laws and regulations and, with the exception of the following, does not otherwise contain substantive changes to the County benefit plans: • Extends the 30- and 60-day HIPAA special enrollment periods by requiring the Plan to disregard the COVID-19 “Outbreak Period,” which started March 1, 2020, and ends 60 days after the end of the COVID-19 national emergency, or a different date announced by the governing federal agencies in a future notice. • Provides that the Plan must disregard the Outbreak Period in determining certain periods and deadlines with respect to COBRA continuation coverage, including: the 60-day election period for COBRA continuation coverage; the date for making COBRA continuation coverage premium payments; and the notification date for individuals to tell the Plan of a qualifying event or disability. • Amends the Dependent Care Spending Account Plan, the Health Care (Flexible) Spending Account Plan, and the Limited Purpose (Flexible) Spending Account Plan for purposes of the plan year beginning July 1, 2019, to permit employees to (i) apply unused amounts remaining as of the end of each plan’s grace period (September 15) to pay or reimburse expenses incurred for the same qualified benefit through December 31, 2020; and (ii) submit any claims for benefits that are incurred on or before December 31, 2020, for payment no later than 45 days after December 31, 2020; provided, that the Outbreak Period shall be disregarded for determining the 45-day deadline, if the Outbreak Period otherwise impacts this 45 day deadline.
