53. RESOLUTION FOR DEVELOPMENT AGREEMENT WITH ARIZONA MOTORSPORTS PARK, LLC Approve by Resolution of Adoption the Development Agreement with Arizona Motorsports Park, LLC, (AMP) an Arizona limited liability company, and Maricopa County memorializing settlement of litigation previously approved by the Board. On December 19, 2001, the Board approved a racetrack facility per Special Use Permit (SUP) case Z2001050. The SUP was subsequently revoked. Litigation was filed by AMP seeking to overturn the revocation. The litigation between parties has been settled. It was agreed that the facility could continue to operate under the SUP as amended, subject to certain noise restrictions. This development agreement memorializes the terms of the settlement by specifying the noise restrictions, the penalties for failure to adhere to those restrictions, and the obligations of each party. ARIZONA MOTORSPORTS PARK FIRST AMENDMENT TO DEVELOPER’S AGREEMENT Approve and authorize the Chairman to execute First Amendment to Developer’s Agreement with Arizona Motorsports Park, LLC and Maricopa County. The original agreement serves as part of previous Special Use Permit approvals. This first amendment revises the original agreement for matters pertaining to maintenance of drainage facilities along the north side of Camelback Road and release of assurance(s); and must be approved by the Board of Supervisors. This agreement to be recorded as required pursuant to A.R.S. §11-1101. (Supervisor District 4) (C-44-11-005-M-00)
