Site Size: Approximately 20 acres County Island Status: Class I (City of Glendale) Additional Comments: N/A Commission Recommendation: On 1/22/15, the Commission voted 9-0 to recommend approval of MCP2014002 subject to conditions ‘a’ – ‘f’: Provided the following conditions are met: a. Development and use of the site shall comply with the narrative report entitled, “Plains Cavern Facility Expansion”, consisting of seven (7) pages, dated revised November 10, 2014 and date stamped received November 12, 2014 except as modified by the following conditions. b. Uses on the subject property shall be limited to the following: 1. Brine pond(s) and associated infrastructure and equipment to facilitate LPG storage and distribution. 2. Underground “salt dome” storage caverns and associated infrastructure and equipment. 3. Truck loading/unloading facilities, associated infrastructure and equipment to facilitate LPG storage and distribution. 4. LPG processing equipment (storage tanks, pipelines, etc.) 5. Office, warehouse and maintenance facilities related to the LPG storage and distribution operations. 6. Cavern injection facilities (wellheads, pipelines, etc.) and associated infrastructure and equipment to facilitate LPG storage and distribution. c. The following Maricopa Planning and Development Engineering condition shall apply: 1. A Plan of Development must be approved by the County prior to any application for building permits on the site. d. All development standards and design criteria shall be established at the time of precise Plan of Development. A Plan of Development or amendments thereto shall be approved by the Board of Supervisors. e. Changes to any use or condition approved by the Board of Supervisors shall be processed as a revised application and be subject to approval by the Board of Supervisors. Revised applications shall be in accordance with the applicable zoning and other regulations in effect at the time of amendment application. Non-compliance with the approved Military Compatibility Permit, including the narrative report or approved conditions constitutes a violation in accordance with the Maricopa County Zoning Ordinance. f. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property owner to enjoy uses in excess of those permitted by the underlying zoning existing on the date of application, subject to conditions. It is, therefore, stipulated and agreed that revocation of this Military Compatibility Permit due to the failure to comply with any condition does not reduce any rights that existed on the date of application to use, divide, sell, or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation. The Military Compatibility Permit enhances the value of the property above its value as of the date the Military Compatibility Permit is granted and revocation results in the same value of the property as if the Military Compatibility Permit had never been granted.
