PZ-4. RUSSELL RANCH SOUTH Case # CPA2012012 Supervisor District: 4 Applicant/Owner: HilgartWilson / J and A Camelback Property, LLC Requests: Comprehensive plan amendment (CPA) to change the land use designation from Large Lot Residential (1-2 d.u./ac.) to Small Lot Residential (2-5 d.u./ac.) CPA case approval is by Resolution, attached. Site Location: Approximately at the northwest corner of 181st Ave. and Camelback Rd. (in the Glendale area) Site Size: Approximately 136 acres County Island Status: Class II (City of Glendale) Commission Recommendation CPA2012012 1. On 1/22/15, the Commission voted 7-1 to recommend approval of CPA2012012 subject to conditions ‘a’ – ‘g’: Provided the following conditions are met: a. Development and use of the site shall comply with the narrative report entitled, “Russell Ranch South”, including all exhibits dated revised June 12, 2014, and stamped received June 13, 2014, except as modified by the following conditions. b. If the Board takes action to amend or revert/rescind subsequent zoning, this land use plan shall be considered for amendment. c. The total number of residential units shall not exceed 333 dwelling units. d. Not less than 27 acres shall be developed as open space to include neighborhood park, pocket parks and an internal trail system. At the time of each preliminary plat submission, the developer shall include a description of the status, cumulative acreage and proposed amenities. e. The following Maricopa County Flood Control District (FCD) conditions shall apply: 1. A Floodplain Use Permit must be obtained from the Floodplain Management and Services Division of the Flood Control District. 2. Approval of the Conditional Letter of Map Revision by the Federal Emergency Management Agency (FEMA) will be required prior to Flood Control District recommending approval of the Final Plat. f. The following State Historic Preservation Office (SHPO) condition shall apply: 1. An archeological survey shall be submitted to and approved by the Arizona State Historic Preservation Office prior to issuance of a grading permit or approval of a Final Plat. The applicant must contact the state office prior to initiating disturbance of the site. The applicant shall provide the Planning and Development Department with written proof of compliance with this stipulation. g. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property owner to enjoy uses in excess of those permitted by the land use existing on the date of application, subject to conditions. In the event of the failure to comply with any condition of approval, the property shall change to the land use designation that existed on the date of application. It is, therefore, stipulated and agreed that revocation due to the failure to comply with any conditions does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation. The Comprehensive Plan Amendment enhances the value of the property above its value as of the date the Comprehensive Plan Amendment is granted and changing to the prior land use designation results in the same value of the property as if the Comprehensive Plan Amendment had never been granted.
