PZ-3. OFF-SITE SIGN Case #: MCP2015001 Supervisor District: 4 Applicant/Owner: Tiffany & Bosco / Waste Management of Arizona Inc. Request: Military Compatibility Permit (MCP) with Plan of Development for off-site sign (billboard) in the IND-2 Military Airport and Ancillary Military Facility Overlay Zoning District Site Location: Approximately at the southeast corner of Perryville Rd. and McDowell Rd. (in the Goodyear area). Site Size: Approximately 5,800 sq. ft. County Island Status: Class I (City of Goodyear) Additional Comments: N/A Commission Recommendation: On 4/9/15, the Commission voted 7-0 to recommend approval of MCP2015001 subject to conditions ‘a’ – ‘g’: a. Development of the site shall comply with the site plan entitled, “Military Compatibility Permit – MCP2015001”, consisting of two (2) full-size sheets, dated revised March 11, 2015, and stamped received March 18, 2015, except as modified by the following conditions. b. Development of the site shall be in conformance with the Narrative Report entitled, “Off-Site Sign I-10 & Perryville”, consisting of twenty (20) pages, dated March 18, 2015, and stamped received March 18, 2015, except as modified by the following conditions. c. The following Military Compatibility Permit standards shall apply: 1. Double-faced billboard sign areas – 672 sq. ft. (14’ x 48’) 2. Off-site sign billboard overall height – 70’ (includes 5’ extension for illumination) 3. Illumination – downward shielded 4 lights per sign face – total of 8 lights 4. Side yard setback (south property line) – 1’ setback from southern property line to edge of billboard sign face. The billboard shall not encroach into the property to the south. d. The following Planning Engineering (Drainage, Flood Control and Transportation) comments shall apply: 1. Drainage review of planning and/or zoning cases is for conceptual design only and does not represent final design approval nor shall it entitle applicants to future designs that are not in conformance with Section 1205 of the Maricopa County Zoning Ordinance and the Maricopa County Drainage Policies and Standards. 2. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance and current engineering policies, standards and best practices at the time of application for construction. 3. The project limits are not located within a Special Flood Hazard Area. The applicant should be aware that the Flood Control District of Maricopa County has conducted a major stormwater management study in this area. The Loop 303 Corridor/White Tanks Area Drainage Master Plan (ADMP) is available for use by developers. New development in the wastershed is expected to acknowledge and assess their project for compatibility with the ADMP. Deviations from the ADMP must be documented, and an engineering analysis provided that shows the deviations do not increase downstream flood peaks, volumes or other flood hazards. A copy of the Loop 303 Corridor/White Tanks ADMP is available at the Maricopa County Flood Control District office for review. Please contact Gregory Jones of the District at (602) 506-6637 for specific information about the ADMP. 4. The property is southeast of the intersection McDowell Road and Perryville Road. Both roads are MCDOT operated and maintained roads. If the building permit requires a new driveway in the MCDOT right-of-way, you will need to obtain a Right-of-Way Permit. e. All outdoor lighting shall conform to the Maricopa County Zoning Ordinance. f. Non-compliance with the regulations administered by the Maricopa County Environmental Services Department, Maricopa County Department of Transportation, Drainage Review Division, Planning and Development Department, or the Flood Control District of Maricopa County may be grounds for initiating a revocation of this Military Compatibility Permit as set forth in the Maricopa County Zoning Ordinance. g. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property owner to enjoy uses in excess of those permitted by the underlying zoning existing on the date of application, subject to conditions. It is, therefore, stipulated and agreed that revocation of this Military Compatibility Permit due to the failure to comply with any condition does not reduce any rights that existed on the date of application to use, divide, sell, or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation. The Military Compatibility Permit enhances the value of the property above its value as of the date the Military Compatibility Permit is granted and revocation results in the same value of the property as if the Military Compatibility Permit had never been granted.
