46. GRANITE VISTA DEVELOPMENT AGREEMENT Approve Granite Vista Development Agreement with NSHE Brisbane LLC & Sunset Tartesso LLC (Elliott Homes) and Maricopa County as required by conditions ‘d’ and ‘q.2.’ of the Development Master Plan case (DMP2013006) for Granite Vista previously approved on August 27, 2014. As conditions of the DMP approval, the applicant is required to enter into a development agreement with Maricopa County to address potential short- and long-term fiscal impacts to Maricopa County. This agreement must be approved by the Board of Supervisors prior to approval of any Final Plat associated with the DMP. This agreement to be recorded as required pursuant to A.R.S. §11-1101. A-3. ADMINISTRATIVE CORRECTION REGARDING THE GRANITE VISTA DEVELOPMENT AGREEMENT Approve an administrative correction to agenda item C-44-15-087-3-00 regarding the Granite Vista Development Agreement approved on May 20, 2015 to include a Resolution authorizing the Development Agreement. The attached Resolution, effective May 20, 2015, is issued in accordance with ARS §§11-251, 11-251.05 and 11-1101 and authorizes the County to enter into the Development Agreement with the Owner for the Development Master Plan known as Granite Vista (the “Granite Vista DMP”) to help ensure timely and efficient development of infrastructure and services for future residents within the Property described therein, and to help minimize fiscal impacts to County residents and taxpayers. The Board Maricopa County Board of Supervisors previously approved the Granite Vista DMP on August 27, 2014 (DMP2013006). The DMP included a stipulation requiring Owner to enter into a development agreement with Maricopa County, but the item did not include a resolution authorizing the same. To comply with the law, the Board approves the attached Resolution. (C-44-15-087-3-01)
