5. RESOLUTION FOR ZANJERO TRAILS (WINDROSE) – PHASE 1 - PARCEL 35B, PHASE 1B SUPPLEMENTAL AGREEMENT TO CONSTRUCT SUBDIVISION IMPROVEMENTS THIRD PARTY TRUST Approve a Resolution authorizing execution of the Zanjero Trails (Windrose) Parcel 35B, Phase 1B Supplemental Agreement to Construct Subdivision Improvements (the “Assurance Agreement”) among First American Title Insurance Company (Trustee), and Maricopa County Municipal Water Conservation District Number One, a political subdivision of the State of Arizona (Beneficiary) and Maricopa County. This Assurance Agreement would supplement the phased construction of the second phase of the Zanjero Trails Development Master Plan for Phase 1 - Development Parcel 35B (Phase 1B) related to on site subdivision improvements. This Assurance Agreement must be authorized by Resolution of the Board of Supervisors prior to approval of the Infrastructure Re-Plat associated with the DMP. This agreement is to be recorded as required pursuant to A.R.S. §11-1101. (Supervisor District 4). (C-44-17-040-M-00)
