7. AGREEMENT FOR GUARANTY OF PERFORMANCE FOR MARBELLA RANCH, PARCEL 1 Approve an Agreement between Marbella Ranch Limited Partnership and Maricopa County through the Planning and Development Department, for the purpose of authorizing execution of the Marbella Ranch Parcel 1 Guaranty of Performance Agreement among Marbella Ranch Limited Partnership (Property Owner), builder/purchasers under contract of Parcel 1 and Maricopa County. This Guaranty of Performance Agreement encompasses all of the subdivision plat known as Marbella Ranch Parcel 1 located at the northeast northwest corner of El Mirage Road and Glendale Avenue. This agreement ensures completion of required infrastructure associated with the subdivision (other than those El Mirage Road improvements deferred per the Marbella Ranch Parcel 1 and Parcel 4 Development Agreement). A financial assurance will be in place prior to plat recordation. This agreement must be authorized by Resolution of the Board of Supervisors prior to approval of the final plat for Parcel 1. This agreement is to be recorded as required pursuant to A.R.S. §11-1101. (Supervisor District 4). This Agreement is non-financial and is effective from August 23, 2017 until August 23, 2022.
