105. RELEASE AND TERMINATE THE FALCON VIEW DEVELOPMENT AGREEMENT BETWEEN RICHMOND AMERICAN HOMES OF ARIZONA, INC. AS SUCCESSOR TO EVEREST BETHANY NORTH, LLC AS SUCCESSOR TO EVEREST BETHANY, LLC Release and terminate the Falcon View Development Agreement between Everest Bethany North, LLC and Maricopa County that was approved on December 15, 2010 and recorded on December 17, 2010 (Recordation number 2010-1098291). Per the existing agreement, the Falcon View subdivision may not receive building permits until a new subdivision assurance is submitted and the agreement is terminated. The release of the Falcon View Development Agreement includes signed authorization by Everest Bethany North, LLC, Everest Bethany, LLC and Richmond American Homes of Arizona, Inc. Everest Bethany North, LLC is under contract to Richmond American Homes with a closing date of October 10, 2017. Richmond American Homes will submit a financial assurance to the County following the closing. Once submitted and the agreement terminated, the Planning and Development Department will issue building permits for Richmond American Homes to construct the subdivision infrastructure.
