5. SONORAN EQUINE Case #: Z2023062 Supervisor District: 2 Applicant & Owner: George Everland, Everett Alan Group / Sonoran Equine, LLC Request: Special Use Permit (SUP) for a horse veterinary facility in the Rural-43 zoning district Site Location: Generally located at the NEC of Rio Verde Dr. and 144th St. in the Rio Verde area Commission Recommendation: On 5/9/24, the Commission voted 9-0 to adopt a motion recommending the Board of Supervisors approve Z2023062 subject to conditions ‘a’ – ‘i’: a. Development of the site shall be in substantial conformance with the narrative report entitled “Sonoran Equine”, consisting of 6 pages, dated January 31, 2024, except as modified by the following conditions. b. Development of the site shall be in substantial conformance with the site plan entitled “Sonoran Equine Special Use Permit “, consisting of 3 full-size sheets, received March 19, 2024, except as modified by the following conditions. Staff may determine slight refinements to remain in substantial conformance with the approved site plan. Minor and major amendments to the site plan will be determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance. c. This SUP is valid for a period of 20 years and shall expire on June 1, 2044, or upon termination of the use for a period of 90 or more days, whichever occurs first. All site improvements associated with the SUP shall be removed within 90 days of such expiration or termination of use. d. Prior to or concurrent with the submittal of the initial building permit for any portion or phase of this development, a traffic impact statement must be approved by the Maricopa County Department of Transportation (MCDOT). e. Flood permits must be issued for all structures on the site prior to issuance of building permits, including for those on the agriculturally exempt portion of the site. Submittals for any building permit must include a grading and drainage plan and a drainage report. f. The following Rural-43 SUP standards shall apply: 1. Allowed uses: All uses allowed under MCZO 503.1 and MCZO 1301.1.20. 2. Rear yard (eastern line of the SUP area): 0’ required setback. 3. Paving: decomposed granite allowed to be used outside of parking spaces (MCZO 1102.7.1.) g. Noncompliance with any Maricopa County Regulation may be grounds for initiating a revocation of this SUP per the procedures set forth in the Maricopa County Zoning Ordinance. h. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. i. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, or the expiration of the SUP, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the SUP. The SUP enhances the value of the property above its value as of the date the SUP is granted and reverting to the prior zoning results in the same value of the property as if the SUP had never been granted.
