25. COMPENSATE BACK WAGES RESULTING FROM CHANGES IN THE FAIR LABOR STANDARDS ACT STATUS FROM EXEMPT TO NON-EXEMPT Approve a lump sum payment to compensate Susan Regan in Superior Court for back wages resulting from a recent re-evaluation of the employee’s position classification and a resulting change in the Fair Labor Standards Act (FLSA) status of the position from exempt to non-exempt. Susan Regan was misclassified as FLSA exempt and, therefore, was not paid for overtime hours worked from April 4, 2009 to April 4, 2011. All records were reviewed, resulting in a lump sum payment totaling $3,548.72, which will compensate her for all overtime back wages owed. The full amount of this request will be funded within the department’s current budget. (C-49-11-071-6-00)
