14. INTERGOVERNMENTAL AGREEMENT WITH TOWN OF QUEEN CREEK FOR LAW ENFORCEMENT AND REDUCTION IN SERVICE LEVEL Approve a three-year agreement for Law Enforcement Service between Maricopa County on behalf of the Sheriff's Office and the Town of Queen Creek beginning July 1, 2011 through June 30, 2014. Up to three one-year automatic renewal periods will occur after the end date, unless notice of non-renewal is given by April 15. Termination of this agreement requires a twelve-month written notice. Also approve a waiver to the 90-day notice for increase or decrease in service to accommodate a reduction in service from five (5) beats for four (4) to be effective August 1, 2011. Finally, per ARS §42-17105 approve a reduction in Sheriff's Office (50) FY 2012 General Fund (100) operating (000) revenue and expenditure appropriation of ($523,558). This is the difference between the original FY 2012 budget of $3,718,489 and the FY 2012 combined cost of $3,194,931 (1 month at five beats and 11 months at four beats). This reduction results in the elimination of six deputy sheriff positions originally established for the Town Queen Creek Contract. Individuals will be reassigned to vacant deputy sheriff positions elsewhere in the Sheriff's Office. This is a reimbursement contract. The cost worksheet is updated annually and issued to the Town in February coincidental to the budget preparation process. Any other changes in costs or service require amendments and Board action. 7. AGREEMENT FOR LAW ENFORCEMENT SERVICES WITH THE TOWN OF QUEEN CREEK Approve an Agreement for Law Enforcement Services with the Town of Queen Creek effective July 1, 2014 through June 30, 2017 with up to five, one-year automatic renewals. This Agreement is terminable without cause upon twelve months written notice or within 90 days after receipt of written notice of a breach of contract that does not reach resolution. This contract supersedes the Agreement associated with agenda C-50-11-106-M-00 and Amendment 1 in agenda C-50-11-106-M-01. The value of this contract is $4,261,342 for the first year of service (Initial Term). Additionally, the Town will also reimburse Maricopa County Sheriff's Office for the actual cost of one-time items estimated to total $521,505 in FY 2015. Also approve establishment of eleven (11) FTE positions to meet the increase in the level of service from four beats of service to five beats plus Town-requested additional service positions. New positions requested are: (Effective January 1, 2015) five (5) Patrol Deputy positions (LEO ); one (1) Detective position (LEO); one (1) Sergeant position (LEO Sgt.); and two (2) Community Policing Deputies (LEO), and (Effective September 1, 2014): one (1) Crime Analyst position, and one (1) Clerical Office Assistant position. The positions will be established as continuing positions and would be abolished if the contract is not renewed with incumbents reassigned. Also approve permanent additions to fleet of six (6) fully equipped enforcement SUV's consisting of three fully marked patrol vehicles and three, unmarked detective vehicles the total value for which is $344,268, and one-time additions of two (2) all-terrain vehicles to patrol washes, the total valued for which is $22,500. Specific vehicle information will be included in the County's Fleet Inventory after they are acquired and put into service. The Town funds the initial purchase plus pays incrementally for replacement costs as part of continuing operating expenses charged by the County. Lastly, per A.R.S. 42-17106 approve an increase to the Sheriff's Office General Fund (100) Operating (0000) revenue appropriation of $525,532 and expenditure appropriation of $525,532 ($968,810 annualized) for the additional revenue and expenses resulting from this action. Also approve per A.R.S. 42-17106 an increase to the Sheriff's Office General Fund (100) One-Time (0001) revenue appropriation of $521,505 and expenditures appropriation of $521,505 for one time items that will be purchased and reimbursed by the Town in FY 2015. Intergovernmental revenues are not local revenues for purposes of the constitutional expenditure limitation, and therefore expenditure of the funds is not prohibited by the budget law. This budget adjustment does not alter the budget constraining the expenditure of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. The FY 2015 increase is incremental beginning September 1, 2014 with two additional positions and then adding nine positions January 1, 2015. If, because of the length of time it takes to fill positions, the Sheriff's Office is unable to staff the contract to the levels of service for which the Town is being charged, the Town's costs will be pro-rated until positions are actually filled with a credit for the difference to be applied to the June 2015 monthly bill for service.
