14. DELEGATE AUTHORITY TO APPLY FOR 2016 STATE CRIMINAL ALIEN ASSISTANCE PROGRAM REIMBURSEMENT FUNDS Approve delegation of authority to the Sheriff to apply for FY2016 SCAAP reimbursement funds, per Part I: SCAAP Guidelines issued by the Bureau of Justice Assistance, Office of Justice Programs, U.S. Department of Justice. SCAAP provides federal payments to states and localities that incurred correctional officer salary costs for incarcerating undocumented criminal aliens who have at least one felony and two misdemeanor convictions for violations of state or local law and who are incarcerated for at least 4 consecutive days. The reporting period is July 1, 2014 through June 30, 2015. The application is not specific to any amount and the award is based on a formula comprised of several variables. Subsequent Board action is required to accept any funds awarded that result from this application. The application is due April 13, 2016. The corrections costs are specific to detention classifications, organizational units and activities in the Sheriff’s Office Detention Fund (507) that align with the application criteria and are obtained through County payroll and the ADP/OET staff. The inmate data is specific to the eligible period of incarceration, between July 1, 2014 and June 30, 2015, and is limited to criminal aliens with four or more consecutive days in the County Jail. Inmates housed on behalf of another jurisdiction are not eligible for reimbursement. This data will be obtained from the Sheriff’s Office using Jail Management System (JMS). (C-50-16-077-G-00)

17. ACCEPT FY2016 STATE CRIMINAL ALIEN ASSISTANCE (SCAAP) FUNDS Approve acceptance of $737,649 Federal FY2016 reimbursement funding from the Bureau of Justice Assistance, State Criminal Alien Assistance Program (SCAAP). The corresponding application was approved by the Board of Supervisors (Agenda C-50-16-077-G-00), on March 23, 2016. The Bureau of Justice Assistance allows these funds to be used for corrections purposes only. The specific planned use, as determined by the Office of Management and Budget, will be stated in the electronic request to drawdown the funds not later than November 21, 2016. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditures of these revenues are not prohibited by the budget law. The Sheriff's Office has applied for this formula-based reimbursement on behalf of the County for many years. SCAAP reimburses state and local government agencies a portion of the costs to incarcerate undocumented criminal aliens who are convicted of felony offenses. Indirect costs are not recoverable since only staff whose primary responsibility is the care, custody, or supervision of persons detained (pre-trial detention) and incarcerated (convicted and sentenced) inmates are allowable in the calculation.
