49. FUNDING FROM US DEPARTMENT OF JUSTICE, FEDERAL BUREAU OF INVESTIGATION FOR THE DESERT HAWK VIOLENT CRIME TASK FORCE Approve the Notice of Limits for FY21 State and Local Overtime Reimbursements and acceptance of up to $153,442 in reimbursement funding from the US Department of Justice, Federal Bureau of Investigation for eight (8) officers assigned to FBI managed task forces. The maximum annual overtime amount per officer is $19,180.25. The FBI Desert Hawk Violent Crime Task Force agreement commenced October 1, 2017 and will continue for an indefinite period until terminated by one or both parties. Acceptance of this agreement was approved by the Board of Supervisors on December 13, 2017 under C-18-038-G-00. The FY21 reimbursement funding began retroactively October 1, 2020 and will terminate September 30, 2021. The Sheriff’s Office indirect cost rate for FY21 is 14.6%. Unrecoverable indirect costs have been calculated as up to $22,402.53. The unrecoverable indirect cost of up to $22,402.53 will be covered by the department General Fund. This agreement is recurring, non-competitive, does not require a match and there are no on-going cash contributions after the period end date. This is not a mandated function. It supports the MCSO public safety mandate to identify and target for prosecution criminal enterprise groups responsible for a wide range of illegal activity such as drug trafficking, money laundering, alien smuggling; and crimes of violence such as murder and aggravated assault, robbery, and violent street gangs. The task for also focuses intensely on the apprehension of dangerous fugitives where there is or may be a federal investigative interest. These revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law.
