18. AGREEMENT WITH THE ARIZONA DEPARTMENT OF HOMELAND SECURITY FOR TLO SUSTAINMENT (TLOSUST) - FFY2022 FUNDING Approve the Agreement and acceptance of grant funds to the Sheriff’s Office from the Arizona Department of Homeland Security, TLO Sustainment (TLOSUST) Agreement Number 21-AZDOHS-HSGP-210811-02 in the amount of $76,900 for the award period beginning October 1, 2021 and terminating on September 30, 2022. This Agreement may be terminated by any of the parties by written notice to the other parties thirty (30) business days prior to termination. The funding award is recurring with no match requirement and has been awarded to the Sheriff’s Office for the past fourteen years. The Sheriff’s Office indirect cost rate for FY22 is 14.74%, applicable to the award amount of $76,900 with $12,000 in capital expenses for an indirect cost base of $64,900 and indirect costs of $9,566.26. Indirect costs are unallowable by the terms of this Agreement unless applied for and approved in writing (page 6, Allowable Costs Section, letter A), and $9,566.26 in indirect costs will be absorbed by the General Fund. There are no future or ongoing contributions required after the grant period ends; however, property (items) purchased with these funds must remain available to the unit for the duration of its existence and/or the useful life of the item. This is not a mandated function. It supports the MCSO public safety mandate and provides a benefit to citizens by funding travel and training for multiple law enforcement personnel, resulting in more adequate capabilities to counter acts of terrorism. It also funds communications equipment and device support that allow for integrated information sharing and dissemination, all of which result in a more safe and secure community. This is a competitive award. The Maricopa County Sheriff’s Office is one of several local law enforcement agencies in the Phoenix metro area that participate in this effort. These revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. This amendment extends the expiration date of the Agreement from December 31, 2022, until March 31, 2023. All other terms and conditions are the same. Approval of this item allows additional time to complete the purchase of the portable radio headsets, command dual radio and a MEMO MESH network radio. The original award amount of $76,900 was approved by the Board on October 20, 2021, in action C-50-22-260-X-00. This funding award is recurring and there is no match requirement. It was competitively bid. This is not a mandated function although it supports the MCSO public safety mandate and provides a benefit to the citizens by responding to serious incidents involving hostages and /or individuals which have been identified as having involvement in serious criminal offenses and/or terrorist activities.
