44. DELEGATION OF AUTHORITY FOR FY 2021 SCAAP APPLICATION PROCESS Approve, retroactively, delegation of authority to the Sheriff to apply for FY 2021 SCAAP (State Criminal Alien Assistance Program) reimbursement funds, per Part I: SCAAP Guidelines issued by the Bureau of Justice Assistance, Office of Justice Programs, U.S. Department of Justice. SCAAP provides federal payments to states and localities that incurred correctional officer salary costs for incarcerating undocumented criminal aliens who have at least one felony and two misdemeanor convictions for violations of state or local law and who are incarcerated for at least 4 consecutive days. The reporting period is July 1, 2019 through June 30, 2020. MCSO has applied for this funding on behalf of Maricopa County for approximately 20 years. Approval of this action allows the application process to continue. MCSO will return to the Board for authorization to accept any funding that is awarded pursuant to this application. 39. ACCEPTANCE OF FFY 2021 STATE CRIMINAL ALIEN ASSISTANCE (SCAAP) FUNDING Approve acceptance of $731,427 Federal FY2021 reimbursement funding from the Bureau of Justice Assistance, State Criminal Alien Assistance Program (SCAAP). The corresponding application was approved by the Board of Supervisors (Agenda C-50-23-000-X-00), on July 27, 2022. This has been a reoccurring grant to the County for over 20 years and there is no cash or in-kind matching requirement. Indirect costs are not applicable or recoverable since the reimbursement formula calculation only allows for staff whose primary responsibility is the care, custody, or supervision of persons detained (pre-trial detention) and incarcerated (convicted and sentenced) inmates. This funding is not competitive. There are no future or ongoing contributions required. This grant reimburses a portion of the costs for a mandated requirement--incarcerating undocumented criminal aliens who are convicted of felony offenses. The Bureau of Justice Assistance allows these funds to be used for corrections purposes only. The specific planned use, as designated by the County Budget Office, will be Technology – Offender Management Software to be stated in the electronic request to drawdown the funds. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditures of these revenues are not prohibited by the budget law (C-50-23-000-X-01)
