ESTABLISH COURT-ORDERED FUND FOR PSB STAFFING Authorize the establishment of a new fund, PSB Staffing Fund (Fund 511), as required by the Order issued by the United States District Court on November 8, 2022 in CV -07-2513-PHX-GMS Melendres v. Penzone. Approve the transfer of funds not later than January 6, 2023 in an amount not to exceed ($1,148,491 from the General Fund (100) to the PSB Staffing Fund (511). Approve funding from Unreserved General Fund (100) Operating (OPER) Contingency to fund this transfer: o Decrease the Non Departmental (D470) General Fund (100) Operating (OPER) “Unreserved Contingency” line (4711) expenditure budget by $1,148,491 o Increase the Non Departmental (D470) General Fund (100) Compliance Operating (MEL0) “Transfer to PSB Staffing Fund” line (4712) expenditure budget by $1,148,491 o Increase the Sheriff (D500) PSB Staffing Fund (511) Compliance Operating (MEL0) revenue budget by $1,148,491 o Increase the Non Departmental (D470) Non Departmental Grant Fund (249) Operating (OPER) expenditure budget by $1,148,491 o Offset the fund transfer with adjustments to the Eliminations (D980) Eliminations Fund (900) Operating (OPER) revenue and expenditure budgets. The court demands that MCSO fill all 39 case investigator positions and reduce its backlog by clearing a minimum of 20 additional cases per month. The penalty for not filling all 39 positions beginning 60 days of this order is payment of three times the annual cost to recruit, hire, train and compensate for one year a single PSB budgeted sergeant position each month the courts demands are not met. (Annual cost has been established and reported to be $191,415.12. Thus the monthly penalty would be $574,245.36 per vacancy.) This request projects 2 vacancies in the first month as MCSO achieves compliance. (C-50-23-100-X-00)
