31. TRANSFER OF EXPENDITURE AUTHORITY FOR THE STATE VERSUS MARTINSON CAPITAL CASE Pursuant to A.R.S. 42-17106(B), transfer FY 2011 expenditure appropriation of $600,000 within Non-Departmental (470) General Fund (100) Non-Recurring/Non-Project (0001) from Unreserved Contingency to a new line entitled, “Martinson Capital Case.” Approval of this item will provide a source of funds for the continuing legal representation in the State v Martinson capital case. This action will have a net zero (expenditure) budget impact countywide and does not change the duly adopted (expenditure) budget as approved by the Board of Supervisors. State v Martinson contracted legal defense expenditures totaling $304,755.38 were incurred in FY 2009-10 (also from Non-Departmental, General Government, Non-Recurring/Non Project Contingency), commencing in October, 2009. While it is uncertain whether expenditures for this capital case will continue past FY 2010-11, the trial itself is not currently scheduled to commence until May 10, 2011. (C-56-11-001-M-00)
