30. APPLY AND ACCEPT TITLE IV-E FEDERAL ENTITLEMENT FUNDING FROM THE DEPARTMENT OF HEALTH AND HUMAN SERVICES THRU THE ARIZONA DEPARTMENT OF CHILD SAFETY Approve the application and acceptance of Title IV-E federal entitlement funds from the Department of Health and Human Services thru the Arizona Department of Child Safety in the amount not to exceed $5,000,000 per year for the purpose of supplementing the costs of dependency in Public Defense Services. Authorize the Chairman of the Board of Supervisors to sign all documents related to this award. This grant is an open-ended entitlement. Per the IGA, 75% of the funding must be invested in dependency to supplement Public Defense Services. The other 25% may be used to offset costs to the County. The 25% (approximately $1,250,000) will be used to offset General Fund expenditures. Also, approve the waiver of indirect costs. Public Defense Services will receive a total of up to $5,000,000 annually; at the indirect rate of 11.69%, the indirect costs are estimated at $584,500, all of which will be waived. These indirect costs are not being sought so that the grant funds can be used for contract attorney costs previously funded by the General Fund. The entitlement is re-occurring and is a new award to the department. There are no in-kind match requirements and requires no ongoing cash contributions. This grant award supplements a mandated function. Public Defense Services is the only eligible entity to receive this award. The department will come back to the Board for appropriation adjustments once the actual amount is known. A change in the Child Welfare Policy Manual now allows states to claim federal matching funds through Title IV-E of the Social Security Act to reimburse half the cost of attorneys for children who are eligible for Title IV-E foster care benefits and half the cost of attorneys for their parents. This reimbursement can then be used to supplement the dependency system as outlined in the IGA with the Arizona Department of Child Services. The policy change allows the state to claim reimbursement retroactively for actual expenditures in the period January 1, 2019 to December 31, 2019 and every quarter thereafter. PDS will receive up to $5,000,000 for the initial retroactive period and up to $1.25 million per quarter thereafter. (C-56-20-001-M-00)

AMEND TITLE IV-E FEDERAL ENTITLEMENT FUNDING CONTRACT FROM THE DEPARTMENT OF HEALTH AND HUMAN SERVICES THRU THE ARIZONA DEPARTMENT OF CHILD SAFETY Approve the amendment to the Title IV-E Federal Funding contract from the Department of Health and Human Services thru the Arizona Department of Child Safety. The revisions provides a more defined list of eligible expenditure types for which grant funding may be utilized. In addition, it precludes the County from using 25% of funds received to supplant general fund activities. The department will absorb the expenditures in their general fund appropriation.
