71. APPLY AND ACCEPT EDWARD J. BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT/ DRUG ENFORCEMENT ACCOUNT BYRNE FUNDING Approve the application and acceptance of grant funds from the Edward J. Byrne Memorial Justice Assistance Grant/Drug Enforcement Account (DEA) in the amount not-to-exceed $196,232. The department budgeted $194,215 through the normal annual budget process. Grant funds will be used to partially fund the salaries of attorneys providing legal representation for defendants with drug related charges. The grant award supports mandated legal representation per the United States Constitution. The grant award is competitively pursued and other eligible agencies may or may not apply for this grant award. The grant award begins on July 1, 2020 and ends on June 30, 2021. The Public Defender indirect rate for FY2021 is 14.66%. Unrecoverable indirect costs are estimated to be $28,768. The grant award is reoccurring and has been awarded to the department for the past 30years. The cost of the positions supported by this grant for FY2020-21 total $385,704. If awarded, the grant will cover up to $196,232 and the remaining amount (which includes the in-kind match requirement) will be absorbed by the department’s general fund budget. In the event that the department does not receive funding in future years, grant expenditures will be absorbed by the department’s general fund budget. (C-56-21-000-X-00 )
