96. AMENDMENT TO IGA AND QUITCLAIM DEED FOR THE TRANSFER OF REAL PROPERTY (Supervisorial District: 4) Approve and execute Second Amendment to the Intergovernmental Agreement (IGA) and Quitclaim Deed and all other documents approved by legal counsel required to complete the transaction. Approve and execute the Second Amendment to the Intergovernmental Agreement between Maricopa County and the Flood Control District of Maricopa County for Maintenance of Sun City and Sun City West Drainage Features, a Quitclaim Deed transferring four parcels from Maricopa County to the Flood Control District, and all other documents approved by legal counsel required to complete the transaction. The Second Amendment adds four drainage features identified as Parcel Nos. 37, 38, 39, and 40, associated with APNs 200-33-301, 200-58-217, 230-02-431, and 230-05-944, to the Flood Control District's operations and maintenance responsibilities and requires the County to issue the District a right-of-way permit with no expiration date and at no cost to the District. The Quitclaim Deed conveys the four parcels, identified as FCD Parcel Nos. SCD-MCHD-016, SCD-MCHD-017, SCD-MCHD-019, and SCD-MCHD-020, from Maricopa County to the Flood Control District for $1.00 and other valuable considerations. The original Intergovernmental Agreement, County C-64-00-055-2-00 / FCD C-69-00-028-2-00, was recorded on September 17, 1999, as Maricopa County Recorder No. 1999-0869579 and established operations and maintenance responsibilities for Sun City and Sun City West drainage features. The First Amendment, County C-64-00-055-2-01 / FCD C-69-00-028-2-01, was recorded on May 1, 2019, as Maricopa County Recorder No. 20190314191 and updated the parties' operations and maintenance responsibilities. The proposed Second Amendment, County C-64-00-055-2-02 / FCD C-69-00-028-2-02, adds four additional drainage features to the Flood Control District's operations and maintenance responsibilities. The accompanying Quitclaim Deed transfers the County's right, title, and interest in the four parcels to the Flood Control District. (C-64-00-055-2-02)
