41. IGA WITH THE CITY OF PHOENIX FOR IMPROVEMENTS TO BROADWAY ROAD FROM 51ST AVENUE TO 7TH STREET Approve the Intergovernmental Agreement with the City of Phoenix for Improvements to Broadway Road from 51st Avenue to 7th Street. The City plans to improve Broadway Road from 43rd Avenue to 7th Street and extend Broadway Road from 51st Avenue to 43rd Avenue as part of the Avenida Rio Salado/Broadway Road Project. Approximately 50% of the Project is located within a County Island and the City needs the County’s help in the acquisition of the necessary right-of-way (ROW). The County will assist with the acquisition of the necessary ROW for the project and invoice the City for all reasonable and customary expenses related to the acquisition of ROW. Upon the City’s request, if eminent domain proceedings to condemn ROW within the county’s jurisdiction are deemed necessary, the County shall assume sole responsibility for the management of ROW acquisition activities in accordance with the laws, policies, and procedures that govern the County’s ability to acquire property rights for public purposes. Within 6 months of the acquisition of ROW, the City will initiate the formal annexation process for the roadway within the project area. The City will assume responsibility and liability for construction, operation and maintenance of the roadway until annexation is complete. Supervisory District No. 5 (C-64-12-008-M-00)
