86. REVENUE AGREEMENT WITH MARICOPA ASSOCIATION OF GOVERNMENTS (MAG) FOR THE RIGHT-OF-WAY ACQUISITION AND CONSTRUCTION OF EL MIRAGE ROAD: NORTHERN AVENUE TO PEORIA AVENUE Approve of Revenue Agreement (No. 13-ELM-20-03-D) between Maricopa County (the County), and the Maricopa Association of Governments (MAG) for the right-of-way acquisition and construction of El Mirage Road: Northern Avenue to Peoria Avenue, Maricopa County Department of Transportation ALCP Project, Sub-Project #T367. Approval of this request will authorize the acceptance and expenditure of the funds (Regional Area Road Funds), including any monies in excess of the currently estimated amount of $9,856,123, if adjusted by MAG for inflation. County’s FY 2012-13 indirect cost rate is 6.9%. All costs under this agreement are for capital expenditures which are not subject to indirect cost recovery. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. The approval of this requested action does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. Section 42-17105. In November 2003, the Maricopa Association of Governments (MAG) approved a Regional Transportation Plan (RTP) consisting of highway and public transit projects, among other projects. Some of the projects are funded through a transportation excise tax, approved by the Maricopa County voters in November 2004. Other projects are funded with federal-aid highway funding, based on their eligibility. MAG is required by law to adopt a program that provides for life cycle management of the funding and programming of the Arterial Life Cycle Program (ALCP), as part of the RTP. MCDOT Sub-Project T367, El Mirage Road: Northern Avenue to Peoria Avenue is included in the MAG RTP ALCP and is eligible for regional funding on a reimbursable basis. Under the approved September 2012 ALCP update, $9,856,123, to be adjusted annually by MAG for inflation, is available for reimbursement of right-of-way acquisition and construction costs in FY2015 through FY2018. In the event of the availability of ALCP closeout funds, some of the reimbursement funding could be received earlier than anticipated. The right-of-way acquisition and construction of this Project will be budgeted in the FY 2014 – 2018 Transportation Improvement Program. As the lead agency, the County has submitted the required MAG Project Overview and must also submit a BOS approved Revenue Agreement to MAG for execution. Without this agreement, the County cannot become authorized to receive the ALCP reimbursement funding. Reimbursements will be sent to the County as part of the ALCP.
