46. IGA WITH THE FLOOD CONTROL DISTRICT OF MARICOPA COUNTY FOR THE AUTOMATED FLOODED ROADWAY WARNING ASSEMBLY PROGRAM Approve the Intergovernmental Agreement (Agreement) between Maricopa County (County) and the Flood Control District of Maricopa County (District) to initiate an Automated Flooded Roadway Warning Assembly Program (Program). The Program is funded by the County through Highway User Revenue Fund (HURF) monies and the District through secondary property tax monies. The estimated cost of this program to the County in FY 2013 is $90,000.00 and $20,000.00 in FY 2014 for the procurement, design, construction, installation, operation and maintenance of the structural components, flashing lights and associated electronics, video surveillance systems, the warning signage of the warning assemblies, and relocation of conflicting utilities. Funds for the project are programmed in the Transportation Capital Projects Fund (234) Transportation Improvement (TIMP) Project, Sub-Project T438, Roadway Flooded Warning Signs. As a first phase of the Program, the County and the District will install one or more demonstration projects, as needed, to observe driver behavior in response to the warning assemblies and evaluate aspects of the Program that may need further evaluation. The observation and evaluation period may take more than two years to complete since it is strictly dependent on flooding conditions. The continuation and/or expansion of the Program will be dependent on the success of the demonstration projects. (C-64-13-150-M-00)

57. IGA WITH THE FLOOD CONTROL DISTRICT OF MARICOPA COUNTY FOR THE AUTOMATED FLOODED ROADWAY WARNING ASSEMBLY PROGRAM Approve an Intergovernmental Agreement (IGA) between Maricopa County Department of Transportation (County) and the Flood Control District of Maricopa County (District) to implement the Automated Flooded Roadway Warning Assembly Program (Program). MCDOT’s FY2016 indirect cost rate is 7.4%. All costs under this Agreement are for capital expenditures, which are not subject to indirect cost recovery. The IGA shall become effective the date it is approved by both the County Board of Supervisors and the Board of Directors of the Flood Control District of Maricopa County, and remain in full force and effect for a period of ten (10) years. The Program shall be annually evaluated with regard to an annual budget and performance evaluation to be developed by the County and District. The cost of this Program will not exceed $400,000 per fiscal year, and can vary between fiscal years, pending Program implementation. Program costs will be split evenly between the County and the District. The County and District will coordinate on the identification of locations for potential installation and phasing of the warning assemblies, including collaborative efforts to promote public awareness of this Program. The Program Costs include warning assembly units and any components or parts needed for installation, installation of the warning assemblies, operations and maintenance, and rights-of-way at mutually agreed upon locations. The County will serve as the lead agency for the Program, while coordinating as needed with the District during the Program activities. The County and District previously entered into an IGA FCD2010A017 (C-64-13-150-M-00) effective June 12, 2013, which is superseded by this new Agreement. Both agencies agree it’s mutually beneficial to continue the Program, and that costs and responsibilities for the PROGRAM should be shared as identified in this Agreement.
