86. MASTER ELECTRICAL & OPERATION AGREEMENT FOR STATE HIGHWAY TRAFFIC SIGNALS AND INTERSECTION LIGHTING WITH THE STATE OF ARIZONA Approve a Master Electrical & Operation Agreement (Agreement) between the State of Arizona, acting by and through its Department of Transportation (State) and Maricopa County, acting by and through its Transportation Director and the Board of Supervisors (County). The State and the County collectively are referred to as the “Parties”. The Parties agree that the County will set aside sufficient funds and be responsible for all electrical energy costs to operate traffic signals and/or intersection lighting at various locations within County boundaries intersecting with the State Highway System. The State will maintain the traffic signals and set aside sufficient funds to include monthly telephone charges for traffic signal interconnect circuits when utilized. There is no financial impact since there are sufficient funds in the operating budget (Fund 232) for all electrical energy costs to operate the listed traffic signals and/or intersection lighting. The terms, conditions and provisions of this Agreement will remain in effect for successive periods of five (5) years from the effective date and may be amended upon mutual consent of both Parities; provided however, that this Agreement may be cancelled at any time with 90 days written notice of either Party. The Parties will review this Agreement 120-days prior to automatic renewal every 5 years, and all reviews shall be completed within 60 days prior to the end of the 5-year anniversary date. The Agreement will be in effect upon the signing and dating of the Determination Letter by the State’s Attorney General. (C-64-13-155-M-00)
