85. REVENUE AGREEMENT WITH MARICOPA ASSOCIATION OF GOVERNMENTS (MAG) FOR THE DESIGN, RIGHT-OF-WAY, AND CONSTRUCTION OF EL MIRAGE ROAD Approve Revenue Agreement (No. 13-ELM-20-03-A) between Maricopa County (the County), and the Maricopa Association of Governments (MAG) for the design, right-of-way and construction of El Mirage Road: Picerne Drive to Bell Road, Maricopa County Department of Transportation Project MAG ALCP, Sub-Project #T341. Approval of this request will authorize the acceptance and expenditure of any future available funds (Regional Area Road Funds). The purposes of this action are: 1) to be responsible for all project costs and submit invoices to MAG for reimbursement; 2) to be responsible for the completion of all surveys, design, plans and specifications, including consultant/contractor selection documents; and 3) to conduct consulta nt/contractor selection process (es) and award the contract(s) pursuant to the applicable laws; 4) purchase or condemn right-of-way and 5) utility relocations. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. The approval of this requested action does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. Section 42-17105. In November 2003, the Maricopa Association of Governments (MAG) approved a Regional Transportation Plan (RTP) consisting of highway and public transit projects, among other projects. Some of the projects are funded through a transportation excise tax, approved by the Maricopa County voters in November 2004. Other projects are funded with federal-aid highway funding, based on their eligibility. MAG is required by law to adopt a program that provides for life cycle management of the funding and programming of the Arterial Life Cycle Program (ALCP), as part of the RTP. The work phases of MCDOT Sub-Project T341, El Mirage Road: Picerne Drive to Bell Road are included in the MAG RTP ALCP as project ACI-ELM-20-03-A and, while eligible for regional funding (Regional Area Road Funds), they are unfunded. In the event of the availability of ALCP closeout funds, this agreement would be amended and regional funds allocated. As the lead agency, the County has submitted the required MAG Project Overview and must also submit a BOS approved Revenue Agreement to MAG for execution. Without this agreement, the County cannot become authorized to receive the ALCP reimbursement funding when funding becomes available. Reimbursements will be sent to the County as part of the ALCP.
