47. JOINT PROJECT AGREEMENT WITH THE STATE OF ARIZONA FOR ADVANCE CONSTRUCTION OF NORTHERN PARKWAY PHASE 2, DYSART OVERPASS Approve a joint project agreement (JPA) with the State of Arizona, by and through the Arizona Department of Transportation, the Maricopa Association of Governments (MAG) and Maricopa County through its Department of Transportation (MCDOT), regarding the advance design and construction of Northern Parkway Phase 2, Dysart Overpass. The JPA will be in effect upon the signing and dating of the Determination Letter by the State’s Attorney General and will remain in effect until the terms of the JPA are satisfied. Authorize MCDOT to apply for, accept and expend federal-aid highway funding reimbursements (grant funds) up to the total project cost amount provided as adjusted for inflation by MAG. Authorize the acceptance and expenditure of additional federal-aid funding if it becomes available and allocated by MAG to MCDOT for this project. The Maricopa County Department of Transportation's FY 2013-14 indirect cost rate is 8.0%. The total grant amount is for capital expenditures which are not subject to indirect cost recovery. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. The approval of this action requested does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. 64. AMENDMENT TO JOINT PROJECT AGREEMENT WITH THE STATE OF ARIZONA AND MARICOPA ASSOCIATION OF GOVERNMENTS FOR CONSTRUCTION ON NORTHERN PARKWAY: DYSART ROAD AND EL MIRAGE OVERPASSES Approve Amendment Number One (Amendment) to the IGA with Arizona Department of Transportation (ADOT) and the Maricopa Association of Governments (MAG) 13-0002783-I (Agreement) and Maricopa Association of Governments (MAG) to consolidate projects T0153 01C (TT0499) Northern Parkway: El Mirage Road Overpass and SZ092 01C (TT0427) Northern Parkway: Dysart Road Overpass into one single construction project SZ092 01C (TT0427). The Agreement was approved by the Maricopa County Board of Supervisors October 9, 2013 and recorded as Maricopa County Recorder Number C-64-14-023-M-00. The Amendment combines the construction of the El Mirage Road Overpass with the Dysart Road Overpass. In discussions between the Maricopa County Department of Transportation (MCDOT), ADOT and MAG, all parties agreed that combining these projects would result a more economical construction project.
