67. MEMORANDUM OF UNDERSTANDING WITH MARICOPA ASSOCIATION OF GOVERNMENTS FOR PRE-DESIGN OF MCKELLIPS ROAD: L101 TO ALMA SCHOOL ROAD Approve Memorandum of Understanding (MOU) (No. 14-MOU-MCK-40-03) between Maricopa County (the County), and the Maricopa Association of Governments (MAG) for the pre-design of McKellips Road from Loop 101 to Alma School Road, Maricopa County Department of Transportation, MAG ALCP, Sub-Project #T342. Approval of this request will authorize the acceptance and expenditure of the funds (Federal Surface Transportation Program funds), currently estimated at $581,000. County funds are available through Transportation Department (640) Capital Project fund (234) MAG ALCP Project, Sub-Project T342. County’s FY 2014 indirect cost rate is 8.0%. All costs under this MOU are for capital expenditures which are not subject to indirect cost recovery. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation. The approval of this requested action does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. Section 42-17105. MCDOT Sub-Project T342, McKellips Road from the Loop 101 to Alma School Road is included in the MAG Regional Transportation Plan (RTP) Arterial Life Cycle Program (ALCP) and is eligible for regional funding (federal Surface Transportation Program funds) on a reimbursable basis. Under the approved September 16, 2013 ALCP update, $581,000 is available for reimbursement of the pre-design study costs. The study is expected to be completed by the end of FY 2015 and cost $830,000 of which $581,000 is reimbursable. The Memorandum of Understanding is required so the County can receive the ALCP reimbursement funding. Pending the results of the pre-design study, the County will enter into the required MAG Project Overview and Revenue Agreement for design and construction of the project if a project is recommended in the pre-design study.
