46. AUTHORIZE MARICOPA COUNTY ATTORNEY'S OFFICE TO APPEAR AS AMICUS CURIAE Request the Board of Supervisors to authorize the Maricopa County Attorney’s Office (MCAO) to appear as amicus curiae in support of the State of Arizona in the matter of Glazer v. State, No. 1 CA-CV 12-0572. Glazer v. State is an appeal from a verdict holding the State of Arizona liable for negligence in failing to install cable barriers in a road which was properly designed and constructed at the time it was built, the immunity provisions of A.R.S. Section 12-820.03 notwithstanding. A.R.S. Section 12-820.03 provides that “neither a public entity nor a public employee is liable for an injury arising out of a plan or design for construction or maintenance of or improvement to highways, roads, streets, bridges, or rights-of-way if the plan or design is prepared in conformance with generally accepted engineering or design standards in effect at the time of the preparation of the plan or design, provided, however, that reasonably adequate warning shall be given as to any unreasonably dangerous hazards which would allow the public to take suitable precautions.” The Attorney General’s Office has requested that Maricopa County and other jurisdictions with transportation responsibilities appear as amicus curiae in support of the State’s petition to the Arizona Supreme Court in its attempt to overturn the decision of the Court of Appeals and restore the immunity from liability from injuries occurring on roads properly designed and constructed. Supervisory Districts No. 1, 2, 3, 4 and 5 (C-64-14-132-M-00)
