58. MARICOPA COUNTY V. DIRT 101 INVESTMENT, LLC, CV2014-006046 Authorize the Maricopa County Attorney’s Office to settle Defendants’ claims in Maricopa County v. Dirt 101 Investment, LLC, et al., CV2014-006046, arising from the reduced land acquisition for the Northern Parkway project, by the County’s payment of $160,000 in exchange for (1) Defendants’ withdrawal of objection to the County’s Verified Motion for Leave to Amend First Amended Complaint; (2) Defendants’ withdrawal of their Motion to Dismiss; (3) Defendants’ waiver of claims to modify the date of valuation; (4) Defendants’ release of claims for compensation for the temporary taking of a portion of their property; and (5) Defendants’ release of claims for reimbursement of fees and expenses pursuant to A.R.S. § 11-972(A)(2), to be memorialized in an agreement between Defendants and Maricopa County in a form to be approved by the Maricopa County Attorney’s Office.
