43. IGA WITH CITY OF PHOENIX FOR IMPROVEMENTS TO MARICOPA COUNTY HIGHWAY 85 Approve an Intergovernmental Agreement between Maricopa County and City of Phoenix for the improvements to Maricopa County Highway 85 (MC85) from 107th Avenue to 75th Avenue. The purpose of this Agreement is to identify and define the roles and responsibilities of each Party with respect to the widening of MC85 from 107th Avenue to 75th Avenue. The project is separated into two phases: Phase One is 95th Avenue to 75th Avenue (TT345); Phase Two is 107th Avenue to 95th Avenue (TT511); and. The project will consist of widening to a five-lane section with turn lanes, raised medians and traffic signals at the intersections, curb, gutter, bike lanes, sidewalks, street lighting, utility relocations and major cross-street improvements approximately one-quarter mile north and south of MC85. Improvements will also include drainage basins and railroad improvements at 107th Avenue. The estimated total project cost to complete Phase One of the Project (TT345) is $27.77 million. The estimated total project cost to complete Phase Two of the Project (TT511) is $19.21 million. The City of Phoenix’s financial contribution will consists of no-cost permits; signing, striping, and the maintenance and operations of the roadway, excluding traffic signals, drainage basins, ITS communication and electronic infrastructure. Construction of Phase One is planned to start in FY 2017, followed by Phase Two construction starting in FY 2018. Construction of both phases planned to be completed in FY 2019. The terms of the agreement are in effect as of Board of Supervisors approval and shall remain in full force and effect until all stipulations have been satisfied, except that the agreement may be amended upon written agreement by both Parties. 35. BID AND AWARD FOR CONSTRUCTION OF ROADWAY WIDENING FOR MC 85, 95TH AVENUE TO 75TH AVENUE Approve the solicitation of bids for the Maricopa County Department of Transportation’s construction of roadway widening for MC 85, 95th Avenue to 75th Avenue, including drainage system, lateral basins, utilities relocations, street lighting, traffic signals, curbs, gutters, asphalt concrete pavement, signing and striping. Award the contract to the lowest responsive bidder, provided that the lowest bidder does not exceed the Engineer’s estimate by more than ten percent. Funds will be budgeted through the Transportation Department (640) Transportation Capital Projects Fund (234) Transportation System Management (TMAN) Project, Sub-Project TT0345. This project will construct MC 85 (Buckeye Road) from 95th Avenue to 75th Avenue, in partnership with the Cities of Phoenix and Tolleson in conformance with intergovernmental agreements C-64-16-099-M-00 (Phoenix) and C-64-08-162-2-00 (Tolleson). AMENDMENT TO IGA WITH CITY OF PHOENIX FOR IMPROVEMENTS TO MC85 (BUCKEYE ROAD) FROM 107TH AVENUE TO 75TH AVENUE Approve the First Amendment to the Intergovernmental Agreement (C-64-16-099-M-01) between Maricopa County and the City of Phoenix for the Improvements of MC85 (Buckeye Road) from 107th Avenue to 75th Avenue. The purpose of this First Amendment is to amend the 2016 Intergovernmental Agreement (IGA) to establish responsibilities related to developer requirements and to establish procedures for the Parties to invoice and remit payments associated with contributions from private development for Improvements of MC85 (Buckeye Road) from 107th Avenue to 75th Avenue. This First Amendment shall become effective as of the date it is approved by the Maricopa County Board of Supervisors and the Phoenix City Council. To the extent that this First Amendment changes the terms of the 2016 IGA, this First Amendment shall supersede and replace the previous terms in original agreement. (C-64-16-099-M-01)
