89. IGA WITH CITY OF CHANDLER FOR RIGHT-OF-WAY ASSISTANCE TO QUEEN CREEK ROAD TO GILBERT ROAD AND COOPER ROAD Approve the IGA between Maricopa County and the City of Chandler for assistance in acquiring right-of-way and related easements within the County’s jurisdiction; authorize the County’s Legal Representative to perform all acts in the manner required by law to condemn property necessary for the City’s project; and approve the addition of the sub project T542 Queen Creek Road from McQueen Road to Gilbert Road and Cooper Road from Queen Creek Road to Nightingale Lane for FY 2017. The purpose of this IGA is to identify and define the respective roles and responsibilities of the County and the City for the project, including rights-of-way acquisition and annexation of the project and project area. The City is currently developing a project to improve Queen Creek Road from McQueen Road to Gilbert Road and Cooper Road from Queen Creek Road to Nightingale Lane (Project). The City is currently seeking Real Estate Support from the County to acquire right-of-way and related easements within the County’s jurisdiction related to the City’s project. Arizona State Statute § 9-241 prohibits Cities and Towns from acquiring right-of-way through condemnation within the jurisdictional boundaries of the County. The City will reimburse the County for all costs associated with the right-of-way acquisition. When completed, the City’s project will consist of: • Widening Queen Creek Road to six (6) thru lanes with raised landscape median, curb, gutter, and sidewalk; • Widening Cooper Road to four (4) thru lanes with a raised median, curb, gutter, and sidewalk; • Storm water drainage; and • Traffic signal, traffic signal interconnect, and streetlights. The terms of the agreement are in effect as of Board of Supervisors approval and shall remain in full force and effect until all stipulations have been satisfied, except that it may be amended upon written agreement by both parties.
