35. CHANGE ORDER TO CONTRACT WITH COMBS CONSTRUCTION COMPANY, INC. FOR CONSTRUCTION OF ROADWAY WIDENING Approve Change Order No. 9 to delete those items and quantities of work in Contract No. 2018-034 with Combs Construction, Inc. that are located on MC 85 west of 91st Ave., and on 91st Ave., both north and south of MC 85. These items of work in the quantities to be deleted represent $4,670,670.77 (Four Million, Six Hundred and Seventy Thousand, Six Hundred and Seventy Dollars, and Seventy-Seven Cents). This deletion results in a substantial change in the scope of work and therefore requires Board of Supervisors approval. Contract No. 2018-034 was executed on September 12, 2018 in the amount of $20,069,707.53 for improvement on MC 85 between 75th Ave. and the 95th Ave. alignment, and along 83rd and 91st Aves., both north and south of their intersection with MC 85. The work being requested for removal from this contract were contingent upon the completion of the USA Fee Land/Easement land exchange with the Bureau of Reclamation (BOR) necessary for relocation of Salt River Project (SRP) irrigation pipeline infrastructure that is included in the contract. This was anticipated to be no later than December 31, 2018, but is not completed to date, nor will it be prior to expiration of the Contract in July 2020. 36. CHANGE ORDER TO CONTRACT 2018-034 WITH COMBS CONSTRUCTION COMPANY, INC. Approve Change Order No. 10 to Contract 2018-034 with Combs Construction Company, Inc. in the amount of $667,717 to allow MCDOT to compensate Contractor for inefficiencies and other financial damages incurred during the first 10 months (through 11/18/2019) of contract time due to unanticipated utility conflicts. Contract No. 2018-034 was executed on September 12, 2018 in the amount of $20,069,707.53 for improvement on MC 85 between 75th Ave. and the 95th Ave. alignment, and along 83rd and 91st Aves., both north and south of their intersection with MC 85. The majority of the roadway work during this time period was predicated on the successful relocation of SRP Irrigation improvements within the Right-of-Way and dedicated easements. During the replacement of the existing SRPI infrastructure to the new locations, numerous conflicts with other utilities were encountered which were unexpected at the locations and depths encountered, and subsequently brought about delays and/or less efficient production while these conflicts were mitigated. The Contractor itemized their losses, presented to MCDOT prior to and at a 12/18/2019 meeting, concluding with MCDOT management offering this settlement. Supervisory District No. 5 (C-64-18-007-5-01)
