33. IGA WITH THE TOWN OF GILBERT FOR RIGHT-OF-WAY ASSISTANCE FOR LINDSAY ROAD Approve the Intergovernmental Agreement between Maricopa County and the Town of Gilbert for assistance in acquiring right-of-way and related easements within the County’s jurisdiction; authorize the County’s Legal Representative to perform all acts in the manner required by law to condemn property necessary for the Town’s project; and approve the addition of the sub project T582, Lindsay Road from Pecos Road to Germann Road and Germann Road from Val Vista Drive to Gilbert Drive. The purpose of this Intergovernmental Agreement is to identify and define the respective roles and responsibilities of the County and the Town for the project, including rights-of-way acquisition and annexation of the project and project area. The Town is currently developing design plans to improve Lindsay Road from Pecos Road to Germann Road and Germann Road from Val Vista Drive to Gilbert Drive (Project). The Town is currently seeking Real Estate Support from the County to acquire right-of-way and related easements within the County’s jurisdiction related to the Town’s project. Arizona State Statute § 9-241 prohibits Cities and Towns from acquiring right-of-way through condemnation within the jurisdictional boundaries of the County. The Town will reimburse the County for all costs associated with the right-of-way acquisition. When completed, the Town’s project will consist of: • Widen Germann Road to accommodate six (6) lanes (3 eastbound and 3 westbound) with a raised median; • Lindsay Road to accommodate six (6) lanes (3 southbound and 3 northbound) with a raised median; • Other Project features include curb and gutter, sidewalks and driveways, bike lanes, bridge widening, landscaping, street lighting, traffic signals, water lines, sewer lines, reclaimed water lines, drainage, and irrigation. The terms of the agreement are in effect as of Board of Supervisors approval and shall remain in full force and effect until all stipulations have been satisfied, except that it may be amended upon written agreement by both parties.
