63. IGA WITH TOWN OF QUEEN CREEK FOR IMPROVEMENTS TO THE RITTENHOUSE ROAD STRUCTURE OVER THE QUEEN CREEK WASH Approve the Intergovernmental Agreement between Maricopa County and the Town of Queen Creek for the improvements to the Rittenhouse Road Structure over the Queen Creek Wash. On September 28, 2015, the County and the Town entered into an intergovernmental agreement for Improvements and Future Maintenance and Operations Responsibilities for the Rittenhouse Road Structure over the Queen Creek Wash. The Town has requested that the County release the sealed design plans of the bridge structure to the Town, so that it may be incorporated into the Town’s future comprehensive Rittenhouse Road project. Under this Intergovernmental Agreement, the County will transfer the design of the bridge structure and the Clean Water Act Section 404 permit to the Town. The County’s cost share contribution is $2,627,000 for the bridge structure. The Town will lead the project and be responsible for the remaining cost of the Project. The Town of Queen Creek will begin the annexation of the unincorporated areas upon execution of this Agreement. The Town of Queen Creek will be responsible for the maintenance and operations of the structure and improvements when the project is complete. The terms of the agreement are in effect as of Board of Supervisors approval and shall remain in full force and effect until all stipulations have been satisfied, except that it may be amended upon written agreement by both parties.
