56. IGA WITH SALT RIVER PIMA-MARICOPA INDIAN COMMUNITY FOR IMPROVEMENTS TO MCKELLIPS ROAD Approve the Intergovernmental Agreement between Maricopa County (County) and Salt River Pima-Maricopa Indian Community (SRP-MIC) for improvements to McKellips Road. Under this Intergovernmental Agreement, the County will lead the Project to widen McKellips Road to four through lanes with a raised median, curb, gutter, bike lanes, sidewalk, drainage, traffic signals, traffic signal interconnect, intersection lighting, private utility coordination and relocation, and right-of-way and easement acquisition. The road is currently owned and operated by Maricopa County. The estimated cost to complete construction of the Project is $16,353,714. Funds are budgeted in FY2021 Transportation Department (640) Transportation Capital Project Fund (234) Transportation System Management Project, sub-project TT0342. Simultaneously SRP-MIC will upgrade an existing water line and an existing sewer line and, installing infrastructure for future street lighting and landscaping. SRP-MIC will solely be responsible for the costs of these SRP-MIC Project improvements which are estimated $6,300,000. The terms of the agreement are in effect as of the Board of Supervisors approval and shall remain in full force and effect until all stipulations have been satisfied, except that it may be amended upon written agreement by all parties. 63. IGA WITH SALT RIVER PIMA-MARICOPA INDIAN COMMUNITY FOR IMPROVEMENTS TO MCKELLIPS ROAD Approve the First Amendment to the Intergovernmental Agreement (C-64-20-169-M-00) between Maricopa County and the Salt River Pima–Maricopa Indian Community for the Improvements of McKellips Road from State Route 101 to Alma School Road. The purpose of this First Amendment is to amend the financial responsibilities of the 2020 Intergovernmental Agreement. Based on the initial bid result being higher than expected, the Parties have chosen to separate the Project into two (2) phases. The Water and Sewer infrastructure upgrades (Phase I) and the McKellips Road improvements (Phase II). The First Amendment aligns the financial responsibilities consistent with the two project phases. This First Amendment shall become effective as of the date it is approved by the Maricopa County Board of Supervisors and the SRP-MIC Council. To the extent that this First Amendment changes the terms of the 2016 IGA, this First Amendment shall supersede and replace the previous terms in original agreement.
