87. CHANGE ORDER NO. 11 WITH COMBS CONSTRUCTION COMPANY, INC. Approve Change Order No. 11 to allow MCDOT to compensate the Contractor a negotiated amount as settlement of claimed inefficiencies and other financial damages incurred during a 7-month portion of contract time between November 19, 2019 and June 17, 2020, due to unanticipated utility conflicts. This Change Order includes a time extension of 136 calendar days and establishes a new completion date of 11/30/20 (currently 7/17/20), for the cumulative schedule impact associated with the subject inefficiencies of this Change Order No. 11 and the previous Change Order No. 10. Contract No. 2018-034 was executed on September 12, 2018 in the amount of $20,069,707.53 for improvements to MC 85 between 75th Ave and the 95th Ave alignment, and along 83rd and 91st Aves, both north and south of their intersection with MC 85. The majority of the roadway work during this subject 7-month portion of contract time (11/19/19 to 6/17/20) involved constructing the west half of 83rd Ave for 800’ north of MC85; and the north half of MC85 from 79th to 87th Aves; and included roadway earthwork, storm drain pipeline, traffic signals, street lighting, concrete curb/driveways/sidewalk, and pavement structure. This roadway work was underlain by significant existing utility infrastructure of various types (communication, natural gas and electric), of which many were encountered at unexpected locations and depths, during not only the underground work but also the roadway construction activities. The unexpected and conflicting utility conditions brought about delays and lost production to the associated construction activity and the project as a whole while the conflicts were mitigated. The Contractor itemized and presented their claimed losses to MCDOT prior to, and at two meetings of 6/3 and 6/10/20 with MCDOT Management, which concluded with this negotiated, agreed upon settlement. This Change Order extends the contract time 136 calendar days for the cumulative schedule impact associated with the subject inefficiencies settlement of this Change Order No. 11 and the previous Change Order No. 10.
