88. CHANGE ORDER NO. 12 WITH COMBS CONSTRUCTION COMPANY, INC. Approve Change Order No. 12 to allow MCDOT to compensate Contractor for full and complete compensation for all inefficiencies and financial damages their subcontractor incurred as a result of utility conflicts encountered during construction of a SRP Irrigation 42” pipeline and for the performance of extra work as directed. Per plan, the widening of 83rd Avenue to the south of MC85, between Stations 404+00 and 412+00, caused a section of existing SRP Irrigation 42” pipeline currently outside of the roadway to be within the new roadway widening limits. Therefore, this 735-foot-long section of Class III RGRCP pipeline was to be replaced with new stronger Class V RGRCP on the same vertical line and grade. During construction, it was discovered that the designed vertical line and grade of the new pipeline was set to a deeper depth than the existing pipeline. Therefore, two utility crossings, Southwest Gas and CenturyLink, coincidently not shown on the plans, which crossed underneath the existing pipeline, were now in direct conflict with the new pipeline. This caused delays resulting in standby cost for equipment and inefficiencies for the crew which resulted in this entire operation taking four days longer to complete. This change order compensates the subcontractor for the equipment idle time and impacts to their productivity for an average manpower and equipment cost of four crew days. This change order also compensates the same subcontractor, fully and completely, for performance of additional work as directed on other existing SRP Irrigation infrastructure on 83rd Avenue, south of MC85. This work included pavement removal, irrigation pipeline and structure excavation, the construction of a 42” RGRCP pipe collar, and cement slurry backfill to pavement subgrade. 101. CHANGE ORDER NO. 13 WITH COMBS CONSTRUCTION COMPANY, INC. Approve Change Order No. 13 to allow MCDOT to compensate the Contractor for full and complete compensation to the Contractor for cost to complete the project within the time extension established in Change Order 11. Change Order 13 costs will be compensated by new Allowance and Lump Sum items which are based upon material and unit price increases; supervision and Site Special Conditions; additional subcontractor mobilizations; and daily traffic control cost during this time extension. Within the Project limits and along the north side of MC 85 between 91st Avenue and 87th Avenue, there was an existing overhead, multi-circuit 12kV powerline supported on a dozen wood poles which was intended to remain. Based on the pole locations relative to the project improvements, there did not appear to be any conflicts at time of bid. However, the proposed roadway grades and elevations caused the lowering of the existing ground surface elevations at the pole locations. This change, coupled with the adjacent pipeline excavation required to construct a new 30” SRP Irrigation pipeline, now stood to compromise the embedment depth of enough of the wood poles to compromise the safety and integrity of the overhead powerlines. After extensive research and review by SRP Power Distribution, the only option was to convert the overhead facility to an underground facility. This relocation work by SRP took from April 14, 2020 to July 12, 2020 to complete. This has resulted in a delay to the project’s contract work, causing it to be performed outside of the original contract time and built in overhead cost. This work is being performed out of phase, separately from previous subcontractor crew and equipment mobilizations, and beyond the duration of the original lump sum traffic control bid amount. Resolution and relocation of the utilities will cause the completion of this work to be performed outside of the original Contract duration for which supervision and Site Special Conditions will be required resulting in additional cost. 102. CHANGE ORDER NO. 14 WITH COMBS CONSTRUCTION COMPANY, INC, Approve Change Order No.14 to allow MCDOT to compensate the Contractor for negotiated compensation, inclusive of all subcontractors, for claimed delay and standby costs incurred between June 17, 2020 and July 12, 2020. This change order shall be full and complete compensation for all direct costs, (Labor, vehicles and equipment standby), and indirect cost, (Corporate overhead) submitted by and negotiated with the Contractor. This date range covers utility relocation work that was ongoing as of June 17, 2020 and prevented the continuation of work by the Contractor up to and including the date of July 12, 2020. Within the Project limits and along the north side of MC 85 between 91st Avenue and 87th Avenue, there was an existing overhead, multi-circuit 12kV powerline supported on a dozen wood poles which was intended to remain. For reasons described in Change Order 13, it became necessary during construction of the project for the existing overhead power to be relocated and converted to an underground facility. This relocation work by SRP took from April 14, 2020 to July 12, 2020 to complete. Meanwhile, progress on the rest of the project continued and was completed on June 17, 2020. The only area of remaining Contract work was westbound MC85 between 91st and 87th Avenues where the SRP power relocation was occurring. As a result, the Contractor was delayed from performing any Contract work from June 17th to July 12th in this area of the project and is entitled to compensation for the delays in accordance with MAG Specification 109.8.2, Contracting Agency Delay.
