4. DEVELOPMENT AGREEMENT WITH WHISPERING HILLS PHOENIX, LLC Approve the Development Agreement between Maricopa County and Whispering Hills-Phoenix, LLC (Whispering Hills) for facilitation of a portion of Maricopa County Department of Transportation Project (MCDOT) TT0513: 35th Avenue – Carver Road to Elliot Road Project (Project) , and authorize the Chairman to execute the agreement. Whispering Hills is in the process of receiving final approval of its subdivision plans from the City of Phoenix (City) and anticipates development of its property will start on or about December of 2020. 35th Avenue adjacent to the Whispering Hills development is a County road and the Project construction is proposed to begin in January of 2021. The County, City, and Whispering Hills coordinated on many items in an attempt to avoid conflict between the two projects. Whispering Hills is dedicating the right of way required for the Project. In addition, the County and Whispering Hills propose to enter into the Development Agreement to set forth the terms and conditions under which the projects will proceed should Whispering Hills’ development move forward before or after the MCDOT Project begins, or not at all. The agreement specifies acceptance of storm water flows, match points for construction efforts, and a possible cash in-lieu payment by the developer in an effort to avoid unnecessary duplication of effort, conflict, and waste during construction.
