PAB-0138 Set a hearing for December 9, 2020 for Road File No. PAB-0138 to consider the request to abandon a portion of a Federal Patent Easement Number 1221237 lying in the Southwest quarter of Section 27 – T7N, R2E of the Gila and Salt River Meridian, Maricopa Cou nty, Arizona. Located in the general vicinity of 42nd Avenue and Devil Springs Road, and known as Assessor Parcel Number 202-12-054B. Pursuant to provisions in A.R.S. §11-251.16, Maricopa County Ordinance No. P-34 and Maricopa County Department of Transp ortation Procedure # P5203, a NOTICE of the hearing by certified mail shall be sent to the applicant and all abutting property owners no less than 60 days prior to the hearing date. Therefore the date set for the hearing shall be the first board meeting no less than 60 days from the date the Board sets the hearing. In addition, a notice shall be posted in the area of the proposed abandonment no less than 60 days prior to the hearing date. Supervisory District No. 3 (C-64-21-040-X-00)

19. PATENT EASEMENT ABANDONMENT: ROAD FILE NO. PAB-0138 Convene a hearing for Road File No. PAB-0138 to consider the request to abandon a portion of a Federal Patent Easement Number 1221237 lying in the Southwest quarter of Section 27 – T7N, R2E of the Gila and Salt River Meridian, Maricopa County, Arizona. Located in the general vicinity of 42nd Avenue and Devil Springs Road, and known as Assessor Parcel Number 202-12-054B. Notice conditions and the request for comment requirements have been met. Therefore, pursuant to provisions in A.R.S. §11-251.16, Maricopa County Ordinance No. P-34 and Maricopa County Department of Transportation Procedure # P5203, it is recommended by the Department of Transportation Director that the Board of Supervisors resolves to: Abandon the East 25 feet of the West 50 feet, EXCEPT North 25 feet and South 25 feet thereof; and the South 25 feet of the North 50 feet, EXCEPT the West 50 feet thereof; and the North 25 feet of the South 50 feet, EXCEPT the West 50 feet thereof of a Federal Patent Easement, Road File No. PAB-0138. Legal description of the easement to be abandoned is identified as Exhibit "A.” In addition, direct the Clerk of the Board to record the Board of Supervisors resolution with the County Recorder.
